How it all Began:
This April, the Arizona Supreme Court made a ruling which revived a state law from 1864 which made abortion illegal in all forms except if it would save the life of the pregnant woman. The Supreme Court claims that the state must deal with this law before it can uphold any pro-abortion cases.
What is the State Doing About it:
Although, the Arizona Attorney General, Kris Mayes, claims that this law will not be enforced in any way while he is in office. Since then, the Arizona House of Representatives has passed a repeal of the old law by a margin of 32-28. This margin came as 3 Republican representatives voted with all of the 29 Democrat representatives seeking to strike down this law. Now, the bill to repeal the law goes to the Arizona Senate to vote on. The bill is expected to pass the Senate and Gov. Katie Hobbs has stated that if the bill were to reach her desk, she will sign it into law.
If the Bill Does not Pass:
However, if the bill were not to pass, then the law would go into effect, causing Arizona to become one of the top 5 strictest states in the nation on abortion. If the civil war era law were to go into effect, the punishment, were it to be enforced, would be 2-5 years in prison for any abortion provider.
